حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ ، حَدَّثَنَا ابْنُ وَهْبٍ ، حَدَّثَنَا يُونُسُ ، عَنِ ابْنِ شِهَابٍ ، عَنِ ابْنِ الْمُسَيَّبِ ، وَأبِي سَلَمَةَ بْنِ عَبْدِ الرَّحَمْنِ ، أن أبا هريرة رضي الله عنه ، قَالَ : اقْتَتَلَتِ امْرَأَتَانِ مِنْ هُذَيْلٍ ، فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ ، فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا ، فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَضَى أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ وَقَضَى أَنَّ دِيَةَ الْمَرْأَةِ عَلَى عَاقِلَتِهَا .

Urdu Translation

ہم سے احمد بن صالح نے بیان کیا، کہا ہم سے ابن وہب نے بیان کیا، کہا ہم سے یونس نے بیان کیا، ان سے ابن شہاب نے، ان سے ابن المسیب اور ابوسلمہ بن عبدالرحمٰن نے اور ان سے ابوہریرہ رضی اللہ عنہ نے بیان کیا کہ   بنی ہذیل کی دو عورتیں آپس میں لڑیں اور ایک نے دوسری عورت پر پتھر پھینک مارا جس سے وہ عورت اپنے پیٹ کے بچے ( جنین ) سمیت مر گئی۔ پھر ( مقتولہ کے رشتہ دار ) مقدمہ رسول اللہ صلی اللہ علیہ وسلم کے دربار میں لے گئے۔ نبی کریم صلی اللہ علیہ وسلم نے فیصلہ کیا کہ پیٹ کے بچے کا خون بہا ایک غلام یا کنیز دینی ہو گی اور عورت کے خون بہا کو قاتل عورت کے عاقلہ ( عورت کے باپ کی طرف سے رشتہ دار عصبہ ) کے ذمہ واجب قرار دیا۔

English Translation

Narrated Abu Huraira: Two women from Hudhail fought with each other and one of them hit the other with a stone that killed her and what was in her womb. The relatives of the killer and the relatives of the victim submitted their case to the Prophet who judged that the Diya for the fetus was a male or female slave, and the Diya for the killed woman was to be paid by the 'Asaba (near relatives) of the killer.
