حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ عَبْدِ الْمَلِكِ، عَنْ أَنَسِ بْنِ سِيرِينَ، قَالَ: سَأَلْتُ ابْنَ عُمَرَ عَنِ امْرَأَتِهِ الَّتِي طَلَّقَ، فَقَالَ: طَلَّقْتُهَا وَهِيَ حَائِضٌ، فَذُكِرَ ذَلِكَ لِعُمَرَ، فَذَكَرَهُ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: «مُرْهُ فَلْيُرَاجِعْهَا، فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا لِطُهْرِهَا»، قَالَ: «فَرَاجَعْتُهَا، ثُمَّ طَلَّقْتُهَا لِطُهْرِهَا»، قُلْتُ: فَاعْتَدَدْتَ بِتِلْكَ التَّطْلِيقَةِ الَّتِي طَلَّقْتَ وَهِيَ حَائِضٌ؟ قَالَ: «مَا لِيَ لَا أَعْتَدُّ بِهَا، وَإِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ»

Urdu Translation

  عبدالملک نے انس بن سیرین سے روایت کی ، انہوں نے کہا : میں نے حضرت ابن عمر رضی اللہ عنہ سے ان کی اس بیوی کے بارے میں سوال کیا جسے انہوں نے طلاق دی تھی ۔ انہوں نے کہا : میں نے اسے حالت حیض میں طلاق دی تھی ۔ میں نے یہ بات حضرت عمر رضی اللہ عنہ کو بتائی تو انہوں نے یہی بات نبی صلی اللہ علیہ وسلم کو بتائی ۔ اس پر آپ نے فرمایا : " اسے حکم دو کہ وہ اس سے رجوع کرے اور جب وہ پاک ہو جائے تو اسے اس کے طہر میں طلاق دے ۔ " کہا : میں نے اس ( بیوی ) سے رجوع کیا ، پھر اس کے طہر میں اسے طلاق دی ۔ میں نے پوچھا : آپ نے وہ طلاق شمار کی جو اسے حالت حیض میں دی تھی؟ انہوں نے جواب دیا : میں اسے کیوں شمار نہ کرتا؟ اگر میں خود ہی ( صحیح طریقہ اپنانے سے ) عاجز رہا تھا اور حماقت سے کام لیا تھا ( تو کیا طلاق شمار نہ ہو گی

English Translation

Anas b. Sirin reported: I asked Ibn 'Umar (Allah be pleased with them) about the woman whom he had divorced. He said: I divorced her while she was in the state of menses. It was mentioned to 'Umar (Allah be pleased with him) and he then made a mention of that to Allah's Apostle ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ), whereupon he said: Command him to take her back and when the period of menses is over, then (he may divorce her in the state of her purity. He (Ibn Umar) said: So I took her back, then divorced her in her purity. I (the narrator) said: Did you count that divorce which you pronounced in the state of menses? He said: Why should I not have counted that? Was I helpless or foolish?
