وحَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرٍو، وَابْنُ طَاوُسٍ، عَنْ طَاوُسٍ، أَنَّهُ كَانَ يُخَابِرُ، قَالَ عَمْرٌو: فَقُلْتُ لَهُ: يَا أَبَا عَبْدِ الرَّحْمَنِ، لَوْ تَرَكْتَ هَذِهِ الْمُخَابَرَةَ، فَإِنَّهُمْ يَزْعُمُونَ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُخَابَرَةِ، فَقَالَ: أَيْ عَمْرُو، أَخْبَرَنِي أَعْلَمُهُمْ بِذَلِكَ - يَعْنِي ابْنَ عَبَّاسٍ - أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمْ يَنْهَ عَنْهَا، إِنَّمَا قَالَ: «يَمْنَحُ أَحَدُكُمْ أَخَاهُ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ عَلَيْهَا خَرْجًا مَعْلُومًا

Urdu Translation

  سفیان نے ہمیں عمرو اور ابن طاوس سے حدیث بیان کی اور انہوں نے طاوس سے روایت کی کہ وہ ( نقدی کے عوض ) بٹائی پر زمین دیتے تھے ۔ عمرو نے کہا : میں نے ان سے کہا : ابو عبدالرحمٰن! اگر آپ مخابرہ چھوڑ دیں ( تو بہتر ہے ) کیونکہ لوگ سمجھتے ہیں کہ نبی صلی اللہ علیہ وسلم نے مخابرہ سے منع فرمایا ہے ۔ انہوں نے کہا : عمرو! مجھے اس مسئلے کو ان سب کی نسبت زیادہ جاننے والے ، یعنی حضرت ابن عباس رضی اللہ عنہ نے بتایا ہے کہ نبی صلی اللہ علیہ وسلم نے اس سے منع نہیں فرمایا ، آپ نے تو صرف فرمایا تھا : " تم میں سے کوئی اپنے بھائی کو ( زمین ) عاریتا دے یہ اس کے لیے اس کی نسبت بہتر ہے کہ اس پر متعین پیداوار وصول کرے ۔ " ( بلا عوض دینے سے اسے غیر متعین ، وسیع منفعت حاصل ہو گی

English Translation

Tawus reported that he let out his land on rent, whereupon Amr said: I said to him: Abu Abd al-Rahrman, I wish if you abandon this renting of land, for they alleged that Allah's Apostle ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) forbade Mukhabara. He siad: Amr, one who has informed me has the best knowledge of it among them (he meant Ibn Abbas). (He said) that Allah's Apostle ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) did not prohibit it altogether, but said: Lending of land by one among you to his brother is better for him than getting a specified amount of produce from it.
