أَخْبَرَنَا قُتَيْبَةُ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا حَمَّادٌ، ‏‏‏‏‏‏عَنْ أَيُّوبَ، ‏‏‏‏‏‏عَنْ مُحَمَّدٍ،‏‏‏‏ عَنْ يُونُسَ بْنِ جُبَيْرٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ سَأَلْتُ ابْنَ عُمَرَ، ‏‏‏‏‏‏عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ هَلْ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ ؟ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، ‏‏‏‏‏‏فَسَأَلَ عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏ فَأَمَرَهُ أَنْ يُرَاجِعَهَا، ‏‏‏‏‏‏ثُمَّ يَسْتَقْبِلَ عِدَّتَهَا ، ‏‏‏‏‏‏فَقُلْتُ لَهُ:‏‏‏‏ فَيَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ ؟ فَقَالَ:‏‏‏‏ مَهْ، ‏‏‏‏‏‏أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ .

Urdu Translation

یونس بن جبیر کہتے ہیں کہ   میں نے ابن عمر رضی اللہ عنہما سے اس مرد کے متعلق ( مسئلہ ) پوچھا جس کی بیوی حیض سے ہو اور اس نے اپنی بیوی کو طلاق دے دی ہو؟ انہوں نے کہا: کیا تم عبداللہ بن عمر کو پہچانتے ہو؟ انہوں نے اپنی بیوی کو طلاق دی اور وہ ( اس وقت ) حیض سے تھی تو عمر رضی اللہ عنہ نے نبی اکرم صلی اللہ علیہ وسلم سے یہ مسئلہ پوچھا، تو آپ صلی اللہ علیہ وسلم نے عبداللہ بن عمر کو حکم دیا کہ اسے لوٹا لے اور اس کی عدت کا انتظار کرے۔ ( یونس بن جبیر کہتے ہیں ) میں نے ان سے کہا: یہ طلاق جو وہ دے چکا ہے کیا وہ اس کا شمار کرے گا؟ انہوں نے کہا: کیوں نہیں، تم کیا سمجھتے ہو اگر وہ عاجز ہو جاتا ( اور رجوع نہ کرتا یا رجوع کرنے سے پہلے مر جاتا ) اور وہ حماقت کر گزرتا ۱؎۔

English Translation

It was narrated that Yunus bin Jubair said: I asked Ibn 'Umar about a man who divorced his wife while she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar?' He divorced his wife while she was menstruating, and 'Umar asked the Prophet about that, and he told him to take her back, then wait for the right time. I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'
