أَخْبَرَنَا إِسْحَاق بْنُ إِبْرَاهِيمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَنْبَأَنَا جَرِيرٌ، ‏‏‏‏‏‏عَنْ هِشَامِ بْنِ عُرْوَةَ، ‏‏‏‏‏‏عَنْ أَبِيهِ، ‏‏‏‏‏‏عَنْ عَائِشَةَ،‏‏‏‏ قَالَتْ:‏‏‏‏ كَاتَبَتْ بَرِيرَةُ عَلَى نَفْسِهَا بِتِسْعِ أَوَاقٍ فِي كُلِّ سَنَةٍ بِأُوقِيَّةٍ، ‏‏‏‏‏‏فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا، ‏‏‏‏‏‏فَقَالَتْ:‏‏‏‏ لَا، ‏‏‏‏‏‏إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي، ‏‏‏‏‏‏فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ فِي ذَلِكَ أَهْلَهَا، ‏‏‏‏‏‏فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ، ‏‏‏‏‏‏فَجَاءَتْ إِلَى عَائِشَةَ، ‏‏‏‏‏‏وَجَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عِنْدَ ذَلِكَ، ‏‏‏‏‏‏فَقَالَتْ لَهَا:‏‏‏‏ مَا قَالَ أَهْلُهَا، ‏‏‏‏‏‏فَقَالَتْ:‏‏‏‏ لَا، ‏‏‏‏‏‏هَا اللَّهِ إِذًا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ مَا هَذَا ؟ فَقَالَتْ:‏‏‏‏ يَا رَسُولَ اللَّهِ، ‏‏‏‏‏‏إِنَّ بَرِيرَةَ أَتَتْنِي تَسْتَعِينُ بِي عَلَى كِتَابَتِهَا، ‏‏‏‏‏‏فَقُلْتُ:‏‏‏‏ لَا، ‏‏‏‏‏‏إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً، ‏‏‏‏‏‏وَيَكُونُ الْوَلَاءُ لِي، ‏‏‏‏‏‏فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا، ‏‏‏‏‏‏فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ ابْتَاعِيهَا، ‏‏‏‏‏‏وَاشْتَرِطِي لَهُمُ الْوَلَاءَ، ‏‏‏‏‏‏فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ ، ‏‏‏‏‏‏ثُمَّ قَامَ فَخَطَبَ النَّاسَ، ‏‏‏‏‏‏فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ، ‏‏‏‏‏‏ثُمَّ قَالَ:‏‏‏‏ مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ ؟ يَقُولُونَ:‏‏‏‏ أَعْتِقْ فُلَانًا وَالْوَلَاءُ لِي، ‏‏‏‏‏‏كِتَابُ اللَّهِ عَزَّ وَجَلَّ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ، ‏‏‏‏‏‏وَكُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ، ‏‏‏‏‏‏وَإِنْ كَانَ مِائَةَ شَرْطٍ، ‏‏‏‏‏‏فَخَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ زَوْجِهَا، ‏‏‏‏‏‏وَكَانَ عَبْدًا، ‏‏‏‏‏‏فَاخْتَارَتْ نَفْسَهَا ، ‏‏‏‏‏‏قَالَ عُرْوَةُ:‏‏‏‏ فَلَوْ كَانَ حُرًّا، ‏‏‏‏‏‏مَا خَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.

Urdu Translation

ام المؤمنین عائشہ رضی الله عنہا کہتی ہیں کہ   بریرہ رضی اللہ عنہا نے اپنی آزادی کے لیے نو اوقیہ ۱؎ پر مکاتبت کی اور ہر سال ایک اوقیہ ادا کرنے کی شرط ٹھہرائی اور عائشہ رضی اللہ عنہا سے مدد حاصل کرنے کے لیے ان کے پاس آئی۔ انہوں نے کہا: میں اس طرح مدد تو نہیں کرتی لیکن اگر وہ اس پر راضی ہوں کہ میں انہیں ایک ہی دفعہ میں پوری رقم گن دوں اور ولاء ( وراثت ) میرا حق ہو ( تو میں ایسا کر سکتی ہوں ) ، بریرہ اپنے لوگوں کے پاس گئی اور ان لوگوں سے اس معاملے میں بات کی، تو انہوں نے بغیر ولاء ( وراثت ) کے ان کی بات ماننے سے انکار کر دیا ( کہا ولاء ( میراث ) ہم لیں گے ) تو وہ لوٹ کر عائشہ رضی اللہ عنہا کے پاس آئی، اور اسی موقع پر رسول اللہ صلی اللہ علیہ وسلم بھی تشریف لے آئے، بریرہ رضی اللہ عنہا نے اپنے مالک کے جواب سے انہیں ( عائشہ کو ) آگاہ کیا، انہوں نے کہا: نہ قسم اللہ کی جب تک ولاء ( میراث ) مجھے نہ ملے گی ( میں اکٹھی رقم نہ دوں گی ) ، رسول اللہ صلی اللہ علیہ وسلم نے پوچھا: کیا قصہ ہے؟ انہوں کہا: اللہ کے رسول! ( بات یہ ہے کہ ) بریرہ اپنی مکاتبت رضی اللہ عنہا پر مجھ سے امداد طلب کرنے آئی تو میں نے اس سے کہا میں یوں تو مدد نہیں کرتی مگر ہاں اگر وہ ولاء ( میراث ) کو میرا حق تسلیم کریں تو میں ساری رقم انہیں یکبارگی گن دیتی ہوں، اس بات کا ذکر اس نے اپنے مالک سے کیا تو انہوں نے کہا: نہیں، ولاء ( میراث ) ہم لیں گے ( تب ہی ہم اس پر راضی ہوں گے ) ، رسول اللہ صلی اللہ علیہ وسلم نے ( عائشہ سے ) کہا: ”تم اسے خرید لو اور ان کے لیے ولاء ( میراث ) کی شرط مان لو، ولاء اس شخص کا حق ہے جو اسے آزاد کرے ( اس طرح جب تم خرید کر آزاد کر دو گی تو حق ولاء ( میراث ) تم کو مل جائے گا ) “ پھر رسول اللہ صلی اللہ علیہ وسلم کھڑے ہوئے لوگوں کو خطاب کیا ( سب سے پہلے ) اللہ کی حمد و ثنا بیان کی، پھر فرمایا: ”لوگوں کو کیا ہو گیا ہے کہ وہ ایسی شرطیں لگاتے ہیں جو کتاب اللہ ( قرآن ) میں نہیں ہیں، کہتے ہیں: ( ہم سے خرید کر ) آزاد تم کرو لیکن ولاء ( وراثت ) ہم لیں گے۔ اللہ عزوجل کی کتاب بر حق و صحیح تر ہے اور اللہ کی شرط مضبوط، ٹھوس اور قابل اعتماد ہے اور ہر وہ شرط جس کا کتاب اللہ میں وجود و ثبوت نہیں ہے باطل و بے اثر ہے، اگرچہ وہ ایک نہیں سو شرطیں ہوں“، پھر رسول اللہ صلی اللہ علیہ وسلم نے اسے اپنے شوہر کے ساتھ رہنے یا علیحدہ ہو جانے کا اختیار دیا، اس کا شوہر غلام تھا تو اس نے اپنے آپ کو علیحدہ کر لیا۔ عروہ کہتے ہیں: اگر اس کا شوہر آزاد شخص ہوتا تو رسول اللہ صلی اللہ علیہ وسلم اسے ( علیحدہ ہو جانے کا ) اختیار نہ دیتے۔

English Translation

It was narrated that 'Aishah said: Barirah made a contract that she would be freed in return for nine Awaq, one Uqiyyah to be paid each year. She came to 'Aishah asking for help and she said: No, not unless they agree to accept the sum in one payment, and that the Wala' will go to me. Barirah went and spoke to her masters but they insisted that the Wala' should be for them. She came to 'Aishah and the Messenger of Allah came, and she told her what her masters had said. She said: No, by Allah, not unless Wala' is to me. The Messenger of Allah said: What is this? She said: O Messenger of Allah, Barirah came to me and asked me to help her with her contract of manumission, and I said no, not unless they agree to accept the sum in one payment, and that the Wala' will be for me. She mentioned that to her masters and they insisted that the Wala' should be for them. The Messenger of Allah said: Buy her, and stipulate that the Wala' is for the one who sets the slave free. Then he stood up and addressed the people and said: What is the matter with people who stipulate conditions that are not in the Book of Allah, the Mighty and Sublime? They say: 'I set so-and-so free but the Wala' will be to me.' Every condition that is not in the Book of Allah, the Mighty and Sublime, is a false condition, even if there are a hundred conditions. And the Messenger of Allah gave her the choice with regard to her husband who was still a slave, and she chose herself. 'Urwah said: If he had been free the Messenger of Allah would not have given her the choice.
