أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، ‏‏‏‏‏‏عَنْ ابْنِ الْقَاسِمِ، ‏‏‏‏‏‏عَنْ مَالِكٍ، ‏‏‏‏‏‏عَنْ يَحْيَى بْنِ سَعِيدٍ، ‏‏‏‏‏‏عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، ‏‏‏‏‏‏أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ، ‏‏‏‏‏‏وَأَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ اخْتَلَفَا فِي الْمَرْأَةِ تُنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، ‏‏‏‏‏‏فَقَالَ عَبْدُ اللَّهِ بْنُ عَبَّاسٍ:‏‏‏‏ آخِرُ الْأَجَلَيْنِ، ‏‏‏‏‏‏وَقَالَ أَبُو سَلَمَةَ:‏‏‏‏ إِذَا نُفِسَتْ فَقَدْ حَلَّتْ، ‏‏‏‏‏‏فَجَاءَ أَبُو هُرَيْرَةَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ أَنَا مَعَ ابْنِ أَخِي يَعْنِي:‏‏‏‏ أَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ، ‏‏‏‏‏‏فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ يَسْأَلُهَا عَنْ ذَلِكَ، ‏‏‏‏‏‏فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ:‏‏‏‏ وَلَدَتْ سُبَيْعَةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، ‏‏‏‏‏‏فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ قَدْ حَلَلْتِ .

Urdu Translation

سلیمان بن یسار سے روایت ہے کہ   عبداللہ بن عباس رضی اللہ عنہما اور ابوسلمہ بن عبدالرحمٰن کے درمیان اس عورت ( کی عدت ) کے بارے میں اختلاف ہو گیا جو اپنے شوہر کے انتقال کے چند ہی راتوں بعد بچہ جنے۔ عبداللہ بن عباس رضی اللہ عنہما نے کہا: دونوں عدتوں میں سے جس عدت کی مدت زیادہ ہو گی اس پر عمل کرے گی اور ابوسلمہ نے کہا: جب بچہ پیدا ہو جائے گا تو وہ حلال ہو جائے گی، ابوہریرہ رضی اللہ عنہ بھی ( وہاں ) پہنچ گئے ( اور باتوں میں شریک ہو گئے ) انہوں نے کہا: میں اپنے بھتیجے ابوسلمہ بن عبدالرحمٰن کے ساتھ ہوں ( یعنی میری بھی وہی رائے ہے جو ابوسلمہ کی ہے ) پھر ان سبھوں نے ابن عباس رضی اللہ عنہما کے غلام کریب کو ( ام المؤمنین ) ام سلمہ رضی اللہ عنہا کے پاس یہ مسئلہ پوچھنے کے لیے بھیجا وہ پوچھ کر ان لوگوں کے پاس پہنچا اور انہیں بتایا کہ وہ کہتی ہیں کہ سبیعہ رضی اللہ عنہا نے اپنے شوہر کے انتقال کے چند راتوں بعد بچہ جنا پھر اس نے اس بات کا ذکر رسول اللہ صلی اللہ علیہ وسلم سے کیا، آپ نے فرمایا: ”تو حلال ہو چکی ہے ( جس سے بھی تو شادی کرنا چاہے کر سکتی ہے ) “۔

English Translation

It was narrated from Sulaiman bin Yasar that 'Abdullah bin 'Abbas and Abu Salamah bin 'Abdur-Rahman disagreed concerning a woman who gave birth one day after her husband died. 'Abdullah bin 'Abbas said: (She should wait) for the longer of the two periods. Abu Salamah said: When she has given birth, it becomes permissible for her to remarry. Abu Hurairah came and said: I agree with my brother's son -meaning Abu Salamah bin 'Abdur-Rahman. They sent Kuraib, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about that. He came back to them and told them that she said: Subai'ah gave birth one day after her husband died; she mentioned that to the Messenger of Allah and he said: It has become permissible for you to marry.
