حَدَّثَنَا بِذَلِكَ الْحَسَنُ بْنُ عَلِيٍّ الْخَلالُ،‏‏‏‏ حَدَّثَنَا عَبْدُ الرَّزَّاقِ،‏‏‏‏ أَنْبَأَنَا مَعْمَرٌ،‏‏‏‏ عَنْ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ،‏‏‏‏ أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاعْتَرَفَ بِالزِّنَا،‏‏‏‏ فَأَعْرَضَ عَنْهُ،‏‏‏‏ ثُمَّ اعْتَرَفَ،‏‏‏‏ فَأَعْرَضَ عَنْهُ،‏‏‏‏ حَتَّى شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ،‏‏‏‏ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ أَبِكَ جُنُونٌ ؟ ،‏‏‏‏ قَالَ:‏‏‏‏ لَا،‏‏‏‏ قَالَ:‏‏‏‏ أَحْصَنْتَ ،‏‏‏‏ قَالَ:‏‏‏‏ نَعَمْ،‏‏‏‏ قَالَ:‏‏‏‏ فَأَمَرَ بِهِ،‏‏‏‏ فَرُجِمَ بِالْمُصَلَّى،‏‏‏‏ فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ،‏‏‏‏ فَرَّ فَأُدْرِكَ فَرُجِمَ حَتَّى مَاتَ،‏‏‏‏ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْرًا ،‏‏‏‏ وَلَمْ يُصَلِّ عَلَيْهِ. قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ:‏‏‏‏ أَنَّ الْمُعْتَرِفَ بِالزِّنَا إِذَا أَقَرَّ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ،‏‏‏‏ أُقِيمَ عَلَيْهِ الْحَدُّ،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ إِذَا أَقَرَّ عَلَى نَفْسِهِ مَرَّةً،‏‏‏‏ أُقِيمَ عَلَيْهِ الْحَدُّ،‏‏‏‏ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ،‏‏‏‏ وَالشَّافِعِيِّ،‏‏‏‏ وَحُجَّةُ مَنْ قَالَ هَذَا الْقَوْلَ،‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ،‏‏‏‏ وَزَيْدِ بْنِ خَالِدٍ،‏‏‏‏ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَحَدُهُمَا:‏‏‏‏ يَا رَسُولَ اللَّهِ،‏‏‏‏ إِنَّ ابْنِي زَنَى بِامْرَأَةِ،‏‏‏‏ هَذَا الْحَدِيثُ بِطُولِهِ،‏‏‏‏ وَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا،‏‏‏‏ فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا ،‏‏‏‏ وَلَمْ يَقُلْ فَإِنِ اعْتَرَفَتْ أَرْبَعَ مَرَّاتٍ.

Urdu Translation

جابر بن عبداللہ رضی الله عنہما سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں قبیلہ اسلم کے ایک آدمی نے آ کر زنا کا اعتراف کیا، تو آپ نے اس کی طرف سے منہ پھیر لیا، پھر اس نے اقرار کیا، آپ نے پھر منہ پھیر لیا، حتیٰ کہ اس نے خود چار مرتبہ اقرار کیا، تو نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”کیا تم پاگل ہو؟“ اس نے کہا: نہیں، آپ نے پوچھا: کیا تم شادی شدہ ہو؟ اس نے کہا ہاں: پھر آپ نے رجم کا حکم دیا، چنانچہ اسے عید گاہ میں رجم کیا گیا، جب اسے پتھروں نے نڈھال کر دیا تو وہ بھاگ کھڑا ہوا، پھر اسے پکڑا گیا اور رجم کیا گیا یہاں تک کہ وہ مر گیا، رسول اللہ صلی اللہ علیہ وسلم نے اس کے حق میں کلمہ خیر کہا لیکن اس کی نماز جنازہ نہیں پڑھی ۱؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- بعض اہل علم کا عمل اسی پر ہے کہ زنا کا اقرار کرنے والا جب اپنے اوپر چار مرتبہ گواہی دے تو اس پر حد قائم کی جائے گی، احمد اور اسحاق بن راہویہ کا یہی قول ہے، ۳- بعض اہل علم کہتے ہیں: ایک مرتبہ بھی کوئی زنا کا اقرار کر لے گا تو اس پر حد قائم کر دی جائے گی، یہ مالک بن انس اور شافعی کا قول ہے، اس بات کے قائلین کی دلیل ابوہریرہ رضی الله عنہ اور زید بن خالد کی یہ حدیث ہے کہ دو آدمی رسول اللہ صلی اللہ علیہ وسلم تک اپنا قضیہ لے گئے، ایک نے کہا: اللہ کے رسول! میرے بیٹے نے اس کی بیوی سے زنا کیا، یہ ایک لمبی حدیث ہے، ( آخر میں ہے ) نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”انیس! اس کی بیوی کے پاس جاؤ اگر وہ زنا کا اقرار کرے تو اسے رجم کر دو“، آپ نے اس حدیث میں یہ نہیں فرمایا کہ ”جب چار مرتبہ اقرار کرے“ ۲؎۔

English Translation

Narrated Jabir bin 'Abdullah: A man from the tribe of Aslam came to the Prophet (ﷺ) and confessed adultery. He turned away from him, the he confessed (again). Then he turned away from him (again) until he had testified against himself four times. So the Prophet (ﷺ) said: Are you insane? He said: No He said: Are you married? He said: Yes . So he gave the order and he was stoned at the Musalla. He ran when he was stuck by the stones, and he was caught and stoned until he died. So the Messenger of Allah (ﷺ) spoke well of him but he did not perform the (funeral) Salat for him.
