حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ حَرَّقَ نَخْلَ بَنِي النَّضِيرِ وَقَطَعَ، ‏‏‏‏‏‏وَهِيَ الْبُوَيْرَةُ، ‏‏‏‏‏‏فَأَنْزَلَ اللَّهُ:‏‏‏‏ مَا قَطَعْتُمْ مِنْ لِينَةٍ أَوْ تَرَكْتُمُوهَا قَائِمَةً عَلَى أُصُولِهَا فَبِإِذْنِ اللَّهِ وَلِيُخْزِيَ الْفَاسِقِينَ سورة الحشر آية 5 ، ‏‏‏‏‏‏وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ ابْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَقَدْ ذَهَبَ قَوْمٌ مِنْ أَهْلِ الْعِلْمِ إِلَى هَذَا، ‏‏‏‏‏‏وَلَمْ يَرَوْا بَأْسًا بِقَطْعِ الْأَشْجَارِ وَتَخْرِيبِ الْحُصُونِ، ‏‏‏‏‏‏وَكَرِهَ بَعْضُهُمْ ذَلِكَ، ‏‏‏‏‏‏وَهُوَ قَوْلُ الْأَوْزَاعِيِّ، ‏‏‏‏‏‏قَالَ الْأَوْزَاعِيُّ:‏‏‏‏ وَنَهَى أَبُو بَكْرٍ الصِّدِّيقُ أَنْ يَقْطَعَ شَجَرًا مُثْمِرًا، ‏‏‏‏‏‏أَوْ يُخَرِّبَ عَامِرًا، ‏‏‏‏‏‏وَعَمِلَ بِذَلِكَ الْمُسْلِمُونَ بَعْدَهُ، ‏‏‏‏‏‏وقَالَ الشَّافِعِيُّ:‏‏‏‏ لَا بَأْسَ بِالتَّحْرِيقِ فِي أَرْضِ الْعَدُوِّ وَقَطْعِ الْأَشْجَارِ وَالثِّمَارِ، ‏‏‏‏‏‏وقَالَ أَحْمَدُ:‏‏‏‏ وَقَدْ تَكُونُ فِي مَوَاضِعَ لَا يَجِدُونَ مِنْهُ بُدًّا، ‏‏‏‏‏‏فَأَمَّا بِالْعَبَثِ، ‏‏‏‏‏‏فَلَا تُحَرَّقْ، ‏‏‏‏‏‏وقَالَ إِسْحَاق:‏‏‏‏ التَّحْرِيقُ سُنَّةٌ إِذَا كَانَ أَنْكَى فِيهِمْ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما سے روایت ہے کہ   رسول اللہ صلی اللہ علیہ وسلم نے بنو نضیر کے کھجوروں کے درخت جلوا اور کٹوا دیئے ۱؎، یہ مقام بویرہ کا واقعہ ہے، اس پر اللہ تعالیٰ نے یہ آیت نازل کی «ما قطعتم من لينة أو تركتموها قائمة على أصولها فبإذن الله وليخزي الفاسقين» ” ( مسلمانو! ) ، ( یہود بنی نضیر کے ) کھجوروں کے درخت جو کاٹ ڈالے ہیں یا ان کو ہاتھ بھی نہ لگایا اور اپنے تنوں پر ہی ان کو کھڑا چھوڑ دیا تو یہ سب اللہ کے حکم سے تھا اور اللہ عزوجل کو منظور تھا کہ وہ نافرمانوں کو ذلیل کرے“ ( الحشر: ۵ ) ۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اس باب میں ابن عباس رضی الله عنہما سے بھی روایت ہے، ۳- بعض اہل علم کا یہی مسلک ہے، وہ درخت کاٹنے اور قلعے ویران کرنے میں کوئی حرج نہیں سمجھتے ہیں، ۴- بعض اہل علم اس کو مکروہ سمجھتے ہیں، اوزاعی کا یہی قول ہے، ۵- اوزاعی کہتے ہیں: ابوبکر صدیق رضی الله عنہ نے یزید کو پھل دار درخت کاٹنے اور مکان ویران کرنے سے منع کیا، ان کے بعد مسلمانوں نے اسی پر عمل کیا، ۶- شافعی کہتے ہیں: دشمن کے ملک میں آگ لگانے، درخت اور پھل کاٹنے میں کوئی حرج نہیں ہے ۲؎۔ ۷- احمد کہتے ہیں: اسلامی لشکر کبھی کبھی ایسی جگہ ہوتا ہے جہاں اس کے سوا کوئی چارہ نہیں ہوتا، لیکن بلا ضرورت آگ نہ لگائی جائے، ۸- اسحاق بن راہویہ کہتے ہیں: آگ لگانا سنت ہے، جب یہ کافروں کی ہار و رسوائی کا باعث ہو۔

English Translation

Narrated Ibn 'Umar: The Messenger of Allah (ﷺ) burnt the palm trees of Bani Nadir and cut them down at Al-Buwairah. So Allah revealed: Whatever you cut down of their palm trees, or you left them standing on their trunks, then it was by the permission of Allah, and in the order to disgrace the rebellious.(59:5)
