حَدَّثَنَا زِيَادُ بْنُ أَيُّوبَ الْبَغْدَادِيُّ، وَإِبْرَاهِيمُ بْنُ عَبْدِ اللَّهِ الْهَرَوِيُّ، وَمُحَمَّدُ بْنُ كَامِلٍ الْمَرْوَزِيُّ الْمَعْنَى وَاحِدٌ، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ حَدَّثَنَا عَبَّادُ بْنُ الْعَوَّامِ، عَنْ سُفْيَانَ بْنِ حُسَيْنٍ، عَنْ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ كِتَابَ الصَّدَقَةِ، ‏‏‏‏‏‏فَلَمْ يُخْرِجْهُ إِلَى عُمَّالِهِ حَتَّى قُبِضَ فَقَرَنَهُ بِسَيْفِهِ فَلَمَّا قُبِضَ، ‏‏‏‏‏‏عَمِلَ بِهِ أَبُو بَكْرٍ حَتَّى قُبِضَ، ‏‏‏‏‏‏وَعُمَرُ حَتَّى قُبِضَ، ‏‏‏‏‏‏وَكَانَ فِيهِ فِي خَمْسٍ مِنَ الْإِبِلِ شَاةٌ، ‏‏‏‏‏‏وَفِي عَشْرٍ شَاتَانِ، ‏‏‏‏‏‏وَفِي خَمْسَ عَشَرَةَ ثَلَاثُ شِيَاهٍ، ‏‏‏‏‏‏وَفِي عِشْرِينَ أَرْبَعُ شِيَاهٍ، ‏‏‏‏‏‏وَفِي خَمْسٍ وَعِشْرِينَ بِنْتُ مَخَاضٍ إِلَى خَمْسٍ وَثَلَاثِينَ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَفِيهَا ابْنَةُ لَبُونٍ إِلَى خَمْسٍ وَأَرْبَعِينَ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَفِيهَا حِقَّةٌ إِلَى سِتِّينَ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَجَذَعَةٌ إِلَى خَمْسٍ وَسَبْعِينَ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَفِيهَا ابْنَتَا لَبُونٍ إِلَى تِسْعِينَ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَفِيهَا حِقَّتَانِ إِلَى عِشْرِينَ وَمِائَةٍ، ‏‏‏‏‏‏فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ وَفِي كُلِّ أَرْبَعِينَ ابْنَةُ لَبُونٍ، ‏‏‏‏‏‏وَفِي الشَّاءِ فِي كُلِّ أَرْبَعِينَ شَاةً شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَشَاتَانِ إِلَى مِائَتَيْنِ، ‏‏‏‏‏‏فَإِذَا زَادَتْ فَثَلَاثُ شِيَاهٍ إِلَى ثَلَاثِ مِائَةِ شَاةٍ فَإِذَا زَادَتْ عَلَى ثَلَاثِ مِائَةِ شَاةٍ فَفِي كُلِّ مِائَةِ شَاةٍ شَاةٌ، ‏‏‏‏‏‏ثُمَّ لَيْسَ فِيهَا شَيْءٌ حَتَّى تَبْلُغَ أَرْبَعَ مِائَةِ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ مَخَافَةَ الصَّدَقَةِ، ‏‏‏‏‏‏وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ، ‏‏‏‏‏‏وَلَا يُؤْخَذُ فِي الصَّدَقَةِ هَرِمَةٌ وَلَا ذَاتُ عَيْبٍ. وقَالَ الزُّهْرِيُّ:‏‏‏‏ إِذَا جَاءَ الْمُصَدِّقُ قَسَّمَ الشَّاءَ أَثْلَاثًا:‏‏‏‏ ثُلُثٌ خِيَارٌ وَثُلُثٌ أَوْسَاطٌ وَثُلُثٌ شِرَارٌ، ‏‏‏‏‏‏وَأَخَذَ الْمُصَدِّقُ مِنَ الْوَسَطِ وَلَمْ يَذْكُرْ الزُّهْرِيُّ الْبَقَرَ. وَفِي الْبَاب عَنْ أَبِي بَكْرٍ الصِّدِّيقِ، ‏‏‏‏‏‏وَبَهْزِ بْنِ حَكِيمٍ، ‏‏‏‏‏‏عَنْ أَبِيهِ، ‏‏‏‏‏‏عَنْ جَدِّهِ وَأَبِي ذَرٍّ، ‏‏‏‏‏‏وَأَنَسٍ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ عَامَّةِ الْفُقَهَاءِ، ‏‏‏‏‏‏وَقَدْ رَوَى يُونُسُ بْنُ يَزِيدَ وَغَيْرُ وَاحِدٍ، ‏‏‏‏‏‏عَنْ الزُّهْرِيِّ، ‏‏‏‏‏‏عَنْ سَالِمٍ بِهَذَا الْحَدِيثِ وَلَمْ يَرْفَعُوهُ، ‏‏‏‏‏‏وَإِنَّمَا رَفَعَهُ سُفْيَانُ بْنُ حُسَيْنٍ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے زکاۃ کی دستاویز تحریر کرائی، ابھی اسے عمال کے پاس روانہ بھی نہیں کر سکے تھے کہ آپ کی وفات ہو گئی، اور اسے آپ نے اپنی تلوار کے پاس رکھ دیا ۱؎، آپ وفات فرما گئے تو ابوبکر رضی الله عنہ اس پر عمل پیرا رہے یہاں تک کہ وہ بھی فوت ہو گئے، ان کے بعد عمر رضی الله عنہ بھی اسی پر عمل پیرا رہے، یہاں تک کہ وہ بھی فوت ہو گئے، اس کتاب میں تحریر تھا: ”پانچ اونٹوں میں، ایک بکری زکاۃ ہے۔ دس میں دو بکریاں، پندرہ میں تین بکریاں اور بیس میں چار بکریاں ہیں۔ پچیس سے لے کر پینتیس تک میں ایک سال کی اونٹنی کی زکاۃ ہے، جب اس سے زیادہ ہو جائیں تو پینتالیس تک میں دو سال کی اونٹنی کی زکاۃ ہے۔ اور جب اس سے زیادہ ہو جائیں تو ساٹھ تک میں تین سال کی ایک اونٹنی کی زکاۃ ہے۔ اور جب اس سے زیادہ ہو جائیں تو پچہتر تک میں چار سال کی ایک اونٹنی کی زکاۃ ہے اور جب اس سے زیادہ ہو جائیں تو نوے تک میں دو سال کی دو اونٹوں کی زکاۃ ہے۔ اور جب اس سے زیادہ ہو جائیں تو ان میں ایک سو بیس تک تین سال کی دو اونٹوں کی زکاۃ ہے۔ جب ایک سو بیس سے زائد ہو جائیں تو ہر پچاس میں تین سال کی ایک اونٹنی اور ہر چالیس میں دو سال کی ایک اونٹنی زکاۃ میں دینی ہو گی۔ اور بکریوں کے سلسلہ میں اس طرح تھا: چالیس بکریوں میں ایک بکری کی زکاۃ ہے، ایک سو بیس تک، اور جب اس سے زیادہ ہو جائیں تو دو سو تک میں دو بکریوں کی زکاۃ ہے، اور جب اس سے زیادہ ہو جائیں تو تین سو تک میں تین بکریوں کی زکاۃ ہے۔ اور جب تین سو سے زیادہ ہو جائیں تو پھر ہر سو پر ایک بکری کی زکاۃ ہے۔ پھر اس میں کچھ نہیں یہاں تک کہ وہ چار سو کو پہنچ جائیں، اور ( زکاۃ والے ) متفرق ( مال ) کو جمع نہیں کیا جائے گا ۲؎ اور جو مال جمع ہو اسے صدقے کے خوف سے متفرق نہیں کیا جائے گا ۳؎ اور جن میں دو ساجھی دار ہوں ۴؎ تو وہ اپنے اپنے حصہ کی شراکت کے حساب سے دیں گے۔ صدقے میں کوئی بوڑھا اور عیب دار جانور نہیں لیا جائے گا“۔ زہری کہتے ہیں: جب صدقہ وصول کرنے والا آئے تو وہ بکریوں کو تین حصوں میں تقسیم کرے، پہلی تہائی بہتر قسم کی ہو گی، دوسری تہائی اوسط درجے کی اور تیسری تہائی خراب قسم کی ہو گی، پھر صدقہ وصول کرنے والا اوسط درجے والی بکریوں میں سے لے۔ زہری نے گائے کا ذکر نہیں کیا۔ امام ترمذی کہتے ہیں: ۱- ابن عمر کی حدیث حسن ہے، ۲- یونس بن یزید اور دیگر کئی لوگوں نے بھی یہ حدیث زہری سے، اور زہری نے سالم سے روایت کی ہے، اور ان لوگوں نے اسے مرفوع بیان نہیں کیا۔ صرف سفیان بن حسین ہی نے اسے مرفوعاً روایت کیا ہے، ۳- اور اسی پر عام فقہاء کا عمل ہے، ۴- اس باب میں ابوبکر صدیق بہز بن حکیم عن أبیہ عن جدہ معاویۃ بن حیدۃ قشیری ہے ابوذر اور انس رضی الله عنہما سے بھی احادیث آئی ہیں۔

English Translation

Az-Zuhri narrated from Salim from his father: The Messenger of Allah had a letter written about charity, but he had not dispatched it to his governors until he died; he kept it with him along with his sword. When he died, Abu Bakr implemented it until he died, as did Umar until he died. In it was: 'A sheep (is due) on five camels, two sheeps on ten, three sheeps on fifteen, four sheeps for twenty, a Bint Makhad on twenty-five to thirty-five. When it is more than that, then a Bint Labun, (is due, till the number of the camels reaches) forty-five. When it is more than that, then a Hiqqah until sixty. When it is more than that, then a Jadhah until seventy-five. When it is more than one hundred and twenty, then a Hiqqah on every fifty, and a Bint Labun on every forty. For sheep; one sheep (is due) for every forty sheeps until one hundred and twenty. When it is more than that, then two sheeps until two hundred. When it is more than that, then three sheeps until three hundred sheep. When it is more than three hundred sheep, then a sheep on every hundred sheep. Then there is nothing until it reaches four hundred. There is no combining the (property of) individuals nor separating the collective (property) fearing Sadaqah. And fr whatever is mixed together that two own, then they are to refer to the total. Neither an old or defective (animal) may be taken for charity.
