حَدَّثَنَا مَحْمُودُ بْنُ غَيْلَانَ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا سُفْيَانُ، عَنْ حَكِيمِ بْنِ جُبَيْرٍ بِهَذَا الْحَدِيثِ، ‏‏‏‏‏‏فَقَالَ لَهُ عَبْدُ اللَّهِ بْنُ عُثْمَانَ صَاحِبُ شُعْبَةَ:‏‏‏‏ لَوْ غَيْرُ حَكِيمٍ حَدَّثَ بِهَذَا الْحَدِيثِ، ‏‏‏‏‏‏فَقَالَ لَهُ سُفْيَانُ:‏‏‏‏ وَمَا لِحَكِيمٍ لَا يُحَدِّثُ عَنْهُ شُعْبَةُ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ نَعَمْ، ‏‏‏‏‏‏قَالَ سُفْيَانُ:‏‏‏‏ زُبَيْدًا يُحَدِّثُ بِهَذَا، ‏‏‏‏‏‏عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَصْحَابِنَا، ‏‏‏‏‏‏وَبِهِ يَقُولُ الثَّوْرِيُّ، ‏‏‏‏‏‏وَعَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، ‏‏‏‏‏‏وَأَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ إِذَا كَانَ عِنْدَ الرَّجُلِ خَمْسُونَ دِرْهَمًا لَمْ تَحِلَّ لَهُ الصَّدَقَةُ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وَلَمْ يَذْهَبْ بَعْضُ أَهْلِ الْعِلْمِ إِلَى حَدِيثِ حَكِيمِ بْنِ جُبَيْرٍ وَوَسَّعُوا فِي هَذَا، ‏‏‏‏‏‏وَقَالُوا:‏‏‏‏ إِذَا كَانَ عِنْدَهُ خَمْسُونَ دِرْهَمًا أَوْ أَكْثَرُ وَهُوَ مُحْتَاجٌ فَلَهُ أَنْ يَأْخُذَ مِنَ الزَّكَاةِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ وَغَيْرِهِ مِنْ أَهْلِ الْفِقْهِ وَالْعِلْمِ.

Urdu Translation

سفیان نے بھی حکیم بن جبیر سے   یہ حدیث اسی سند سے روایت کی ہے۔ جب سفیان نے یہ حدیث روایت کی تو ان سے شعبہ کے شاگرد عبداللہ بن عثمان نے کہا: کاش حکیم کے علاوہ کسی اور نے اس حدیث کو بیان کیا ہوتا، تو سفیان نے ان سے پوچھا ـ: کیا بات ہے کہ شعبہ حکیم سے حدیث روایت نہیں کرتے؟ انہوں نے کہا: ہاں، وہ نہیں کرتے۔ تو سفیان نے کہا: میں نے اسے زبید کو محمد بن عبدالرحمٰن بن یزید سے روایت کرتے سنا ہے، اور اسی پر ہمارے بعض اصحاب کا عمل ہے اور یہی سفیان ثوری، عبداللہ بن مبارک، احمد اور اسحاق بن راہویہ بھی کہتے ہیں، ان لوگوں کا کہنا ہے کہ جب آدمی کے پاس پچاس درہم ہوں تو اس کے لیے زکاۃ جائز نہیں۔ اور بعض اہل علم حکیم بن جبیر کی حدیث کی طرف نہیں گئے ہیں بلکہ انہوں نے اس میں مزید گنجائش رکھی ہے، وہ کہتے ہیں کہ جب کسی کے پاس پچاس درہم یا اس سے زیادہ ہوں اور وہ ضرورت مند ہو تو اس کو زکاۃ لینے کا حق ہے، اہل فقہ و اہل حدیث میں سے شافعی وغیرہ کا یہی قول ہے۔

English Translation

Mahmud bin Ghaydin narrated to us: Yahya bin Adam narrated to us, Sufyan narrated this Hadith to us from Hakim bin Jubair. So Abdullah bin Uthman, the companion of Shu'bah said to him (Sufyan): If only someone besides Hakim had narrated this (Hadith). Sufyan said to him, So what is with Hakim; Shu'bah would not narrate from him? He said: Yes. So Sufyan said: I heard Zubaid narrating this from Muhammad bin Abdur-Rahman bin Yazid.
