Baab Khareed O Farookht Ke Masail Ka Bayan

Narrated Hakim bin Hizam: Allah's Apostle said, The seller and the buyer have the right to keep or return goods as long as they have not parted or till they part; and if both the parties spoke the truth and described the defects and qualities (of the goods), then they would be blessed in their transaction, and if they told lies or hid something, then the blessings of their transaction would be lost.

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنْ صَالِحٍ أَبِي الْخَلِيلِ ، عَنْ عَبْدِ اللَّهِ بْنِ الْحَارِثِ ، رَفَعَهُ إِلَى حَكِيمِ بْنِ حِزَامٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ، أَوْ قَالَ حَتَّى يَتَفَرَّقَا ، فَإِنْ صَدَقَا وَبَيَّنَا ، بُورِكَ لَهُمَا فِي بَيْعِهِمَا ، وَإِنْ كَتَمَا وَكَذَبَا ، مُحِقَتْ بَرَكَةُ بَيْعِهِمَا .

ہم سے سلیمان بن حرب نے بیان کیا، کہا کہ ہم سے شعبہ نے بیان کیا، ان سے قتادہ نے ان سے صالح ابوخلیل نے، ان سے عبیداللہ بن حارث نے، انہوں نے حکیم بن حزام رضی اللہ عنہ سے کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا، خریدنے اور بیچنے والوں کو اس وقت تک اختیار ( بیع ختم کر دینے کا ) ہے جب تک دونوں جدا نہ ہوں یا آپ صلی اللہ علیہ وسلم نے ( «ما لم يتفرقا» کے بجائے ) «حتى يتفرقا» فرمایا۔ ( نبی کریم صلی اللہ علیہ وسلم نے مزید ارشاد فرمایا ) پس اگر دونوں نے سچائی سے کام لیا اور ہر بات صاف صاف کھول دی تو ان کی خرید و فروخت میں برکت ہوتی ہے لیکن اگر کوئی بات چھپا رکھی یا جھوٹ کہی تو ان کی برکت ختم کر دی جاتی ہے۔
