حَدَّثَنِي سُلَيْمَانُ بْنُ دَاوُدَ أَبُو الرَّبِيعِ ، حَدَّثَنَا فُلَيْحٌ ، عَنِ الزُّهْرِيِّ ، عَنْ سَهْلِ بْنِ سَعْدٍ ، أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ ، أَمْ كَيْفَ يَفْعَلُ ؟ فَأَنْزَلَ اللَّهُ فِيهِمَا مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ ، قَالَ : فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَفَارَقَهَا ، فَكَانَتْ سُنَّةً أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ ، وَكَانَتْ حَامِلًا ، فَأَنْكَرَ حَمْلَهَا ، وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ، ثُمَّ جَرَتِ السُّنَّةُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا ، وَتَرِثَ مِنْهُ مَا فَرَضَ اللَّهُ لَهَا .

Urdu Translation

مجھ سے ابوالربیع سلیمان بن داؤد نے بیان کیا، کہا ہم سے فلیح نے، ان سے زہری نے، ان سے سہل بن سعد نے کہ   ایک صاحب ( یعنی عویمر ) رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے اور عرض کیا: یا رسول اللہ! ایسے شخص کے متعلق آپ کا کیا ارشاد ہے جس نے اپنی بیوی کے ساتھ ایک غیر مرد کو دیکھا ہو کیا وہ اسے قتل کر دے؟ لیکن پھر آپ قصاص میں قاتل کو قتل کر دیں گے۔ پھر اسے کیا کرنا چاہئے؟ انہیں کے متعلق اللہ تعالیٰ نے دو آیات نازل کیں جن میں لعان کا ذکر ہے۔ چنانچہ نبی کریم صلی اللہ علیہ وسلم نے ان سے فرمایا کہ تمہارے اور تمہاری بیوی کے بارے میں فیصلہ کیا جا چکا ہے۔ راوی نے بیان کیا کہ پھر دونوں میاں بیوی نے لعان کیا اور میں اس وقت نبی کریم صلی اللہ علیہ وسلم کی خدمت میں حاضر تھا۔ پھر آپ نے دونوں میں جدائی کرا دی اور دو لعان کرنے والوں میں اس کے بعد یہی طریقہ قائم ہو گیا کہ ان میں جدائی کرا دی جائے۔ ان کی بیوی حاملہ تھیں، لیکن انہوں نے اس کا بھی انکار کر دیا۔ چنانچہ جب بچہ پیدا ہوا تو اسے ماں ہی کے نام سے پکارا جانے لگا۔ میراث کا یہ طریقہ ہوا کہ بیٹا ماں کا وارث ہوتا ہے اور ماں اللہ کے مقرر کئے ہوئے حصہ کے مطابق بیٹے کی وارث ہوتی ہے۔

English Translation

Narrated Sahl bin Sa`d: A man came to Allah's Messenger and said, O Allah's Messenger ! Suppose a man saw another man with his wife, should he kill him whereupon you might kill him (i.e. the killer) (in Qisas) or what should he do? So Allah revealed concerning their case what is mentioned of the order of Mula'ana. Allah's Apostle said to the man, The matter between you and your wife has been decided. So they did Mula'ana in the presence of Allah's Messenger and I was present there, and then the man divorced his wife. So it became a tradition to dissolve the marriage of those spouses who were involved in a case of Mula'ana. The woman was pregnant and the husband denied that he was the cause of her pregnancy, so the son was (later) ascribed to her. Then it became a tradition that such a son would be the heir of his mother, and she would inherit of him what Allah prescribed for her.
