Baab Talaq Ke Masail Ka Bayan

حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ ، قَالَ : حَدَّثَنِي مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مُرْهُ فَلْيُرَاجِعْهَا ، ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ، ثُمَّ تَحِيضَ ، ثُمَّ تَطْهُرَ ، ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ .

Urdu Translation

ہم سے اسماعیل بن عبداللہ اویسی نے بیان کیا، کہا کہ مجھ سے امام مالک نے بیان کیا، ان سے نافع نے اور ان سے عبداللہ بن عمر رضی اللہ عنہما نے کہ   انہوں نے اپنی بیوی ( آمنہ بنت غفار ) کو رسول اللہ صلی اللہ علیہ وسلم کے زمانہ میں ( حالت حیض میں ) طلاق دے دی۔ عمر بن خطاب رضی اللہ عنہ نے نبی کریم صلی اللہ علیہ وسلم سے اس کے متعلق پوچھا: تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ عبداللہ بن عمر رضی اللہ عنہما سے کہو کہ اپنی بیوی سے رجوع کر لیں اور پھر اپنے نکاح میں باقی رکھیں۔ جب ماہواری ( حیض ) بند ہو جائے، پھر ماہواری آئے اور پھر بند ہو، تب اگر چاہیں تو اپنی بیوی کو اپنی نکاح میں باقی رکھیں اور اگر چاہیں تو طلاق دے دیں ( لیکن طلاق اس طہر میں ) ان کے ساتھ ہمبستری سے پہلے ہونا چاہئے۔ یہی ( طہر کی ) وہ مدت ہے جس میں اللہ تعالیٰ نے عورتوں کو طلاق دینے کا حکم دیا ہے۔

English Translation

Narrated `Abdullah bin `Umar: that he had divorced his wife while she was menstruating during the lifetime of Allah's Apostle . `Umar bin Al-Khattab asked Allah's Apostle about that. Allah's Apostle said, Order him (your son) to take her back and keep her till she is clean and then to wait till she gets her next period and becomes clean again, whereupon, if he wishes to keep her, he can do so, and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the prescribed period which Allah has fixed for the women meant to be divorced.
