Baab Talaq Ke Masail Ka Bayan

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ ابْنِ شِهَابٍ ، أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ أَخْبَرَهُ ، أَنَّ عُوَيْمِرًا الْعَجْلَانِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الْأَنْصَارِيِّ ، فَقَالَ لَهُ : يَا عَاصِمُ ، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ ، فَتَقْتُلُونَهُ ، أَمْ كَيْفَ يَفْعَلُ ؟ سَلْ لِي يَا عَاصِمُ عَنْ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَأَلَ عَاصِمٌ عَنْ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَكَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَ عُوَيْمِرٌ ، فَقَالَ : يَا عَاصِمُ ، مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ فَقَالَ عَاصِمٌ : لَمْ تَأْتِنِي بِخَيْرٍ ، قَدْ كَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا ، قَالَ عُوَيْمِرٌ : وَاللَّهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا ، فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَسْطَ النَّاسِ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا ، أَيَقْتُلُهُ فَتَقْتُلُونَهُ ، أَمْ كَيْفَ يَفْعَلُ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : قَدْ أَنْزَلَ اللَّهُ فِيكَ وَفِي صَاحِبَتِكَ ، فَاذْهَبْ فَأْتِ بِهَا ، قَالَ سَهْلٌ : فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا فَرَغَا ، قَالَ عُوَيْمِرٌ : كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ ، إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . قَالَ ابْنُ شِهَابٍ : فَكَانَتْ تِلْكَ سُنَّةُ الْمُتَلَاعِنَيْنِ .

Urdu Translation

ہم سے عبداللہ بن یوسف تینسی نے بیان کیا، کہا ہم کو امام مالک نے خبر دی، انہیں ابن شہاب نے اور انہیں سہل بن سعد ساعدی رضی اللہ عنہ نے خبر دی کہ   عویمر العجانی رضی اللہ عنہ عاصم بن عدی انصاری رضی اللہ عنہ کے پاس آئے اور ان سے کہا کہ اے عاصم! تمہارا کیا خیال ہے، اگر کوئی اپنی بیوی کے ساتھ کسی غیر کو دیکھے تو کیا اسے وہ قتل کر سکتا ہے؟ لیکن پھر تم قصاص میں اسے ( شوہر کو ) بھی قتل کر دو گے یا پھر وہ کیا کرے گا؟ عاصم میرے لیے یہ مسئلہ آپ رسول اللہ صلی اللہ علیہ وسلم سے پوچھ دیجئیے۔ عاصم رضی اللہ عنہ نے جب نبی کریم صلی اللہ علیہ وسلم سے یہ مسئلہ پوچھا تو نبی کریم صلی اللہ علیہ وسلم نے اس سوالات کو ناپسند فرمایا اور اس سلسلے میں نبی کریم صلی اللہ علیہ وسلم کے کلمات عاصم رضی اللہ عنہ پر گراں گزرے اور جب وہ واپس اپنے گھر آ گئے تو عویمر رضی اللہ عنہ نے آ کر ان سے پوچھا کہ بتائیے آپ سے نبی کریم صلی اللہ علیہ وسلم نے کیا فرمایا؟ عاصم نے اس پر کہا تم نے مجھ کو آفت میں ڈالا۔ جو سوال تم نے پوچھا تھا وہ نبی کریم صلی اللہ علیہ وسلم کو ناگوار گزرا۔ عویمر نے کہا کہ اللہ کی قسم! یہ مسئلہ نبی کریم صلی اللہ علیہ وسلم سے پوچھے بغیر میں باز نہیں آؤں گا۔ چنانچہ وہ روانہ ہوئے اور نبی کریم صلی اللہ علیہ وسلم کی خدمت میں پہنچے۔ نبی کریم صلی اللہ علیہ وسلم لوگوں کے درمیان میں تشریف رکھتے تھے۔ عویمر رضی اللہ عنہ نے عرض کیا: یا رسول اللہ! اگر کوئی شخص اپنی بیوی کے ساتھ کسی غیر کو پا لیتا ہے تو آپ کا کیا خیال ہے؟ کیا وہ اسے قتل کر دے؟ لیکن اس صورت میں آپ اسے قتل کر دیں گے یا پھر اسے کیا کرنا چاہیے؟ نبی کریم صلی اللہ علیہ وسلم نے فرمایا کہ اللہ تعالیٰ نے تمہاری بیوی کے بارے میں وحی نازل کی ہے، اس لیے تم جاؤ اور اپنی بیوی کو بھی ساتھ لاؤ۔ سہل نے بیان کیا کہ پھر دونوں ( میاں بیوی ) نے لعان کیا۔ لوگوں کے ساتھ میں بھی رسول اللہ صلی اللہ علیہ وسلم کے ساتھ اس وقت موجود تھا۔ لعان سے جب دونوں فارغ ہوئے تو عویمر رضی اللہ عنہ نے عرض کیا: یا رسول اللہ! اگر اس کے بعد بھی میں اسے اپنے پاس رکھوں تو ( اس کا مطلب یہ ہو گا کہ ) میں جھوٹا ہوں۔ چنانچہ انہوں نے نبی کریم صلی اللہ علیہ وسلم کے حکم سے پہلے ہی اپنی بیوی کو تین طلاق دی۔ ابن شہاب نے بیان کیا کہ پھر لعان کرنے والے کے لیے یہی طریقہ جاری ہو گیا۔

English Translation

Narrated Sahl bin Sa`d As-Sa`idi: Uwaimir Al-`Ajlani came to `Asim bin Adi Al-Ansari and asked, O `Asim! Tell me, if a man sees his wife with another man, should he kill him, whereupon you would kill him in Qisas, or what should he do? O `Asim! Please ask Allah's Apostle about that. `Asim asked Allah's Apostle about that. Allah's Apostle disliked that question and considered it disgraceful. What `Asim heard from Allah's Apostle was hard on him. When he returned to his family, 'Uwaimir came to him and said O `Asim! What did Allah's Apostle say to you? `Asim said, You never bring me any good. Allah's Apostle disliked to hear the problem which I asked him about. 'Uwaimir said, By Allah, I will not leave the matter till I ask him about it. So 'Uwaimir proceeded till he came to Allah's Apostle who was in the midst of the people and said, O Allah's Apostle! If a man finds with his wife another man, should he kill him, whereupon you would kill him (in Qisas): or otherwise, what should he do? Allah's Apostle said, Allah has revealed something concerning the question of you and your wife. Go and bring her here. So they both carried out the judgment of Lian, while I was present among the people (as a witness). When both of them had finished, 'Uwaimir said, O Allah's Apostle! If I should now keep my wife with me, then I have told a lie . Then he pronounced his decision to divorce her thrice before Allah's Apostle ordered him to do so. (Ibn Shihab said, That was the tradition for all those who are involved in a case of Lian.
