Baab Talaq Ke Masail Ka Bayan

حَدَّثَنَا أَزْهَرُ بْنُ جَمِيلٍ ، حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ ، حَدَّثَنَا خَالِدٌ ، عَنْ عِكْرِمَةَ ، عَنْ ابْنِ عَبَّاسٍ ، أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، ثَابِتُ بْنُ قَيْسٍ مَا أَعْتِبُ عَلَيْهِ فِي خُلُقٍ وَلَا دِينٍ ، وَلَكِنِّي أَكْرَهُ الْكُفْرَ فِي الْإِسْلَامِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ ؟ قَالَتْ : نَعَمْ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اقْبَلِ الْحَدِيقَةَ ، وَطَلِّقْهَا تَطْلِيقَةً . قَالَ أَبُو عَبْد اللَّهِ : لَا يُتَابَعُ فِيهِ عَنْ ابْنِ عَبَّاسٍ .

Urdu Translation

ہم سے ازہر بن جمیل نے بیان کیا، کہا ہم سے عبدالوہاب ثقفی نے بیان کیا، کہا ہم سے خالد نے بیان کیا، ان سے عکرمہ نے اور ان سے ابن عباس رضی اللہ عنہما نے کہ   ثابت بن قیس رضی اللہ عنہ کی بیوی نبی کریم صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئی اور عرض کیا کہ یا رسول اللہ! مجھے ان کے اخلاق اور دین کی وجہ سے ان سے کوئی شکایت نہیں ہے۔ البتہ میں اسلام میں کفر کو پسند نہیں کرتی۔ ( کیونکہ ان کے ساتھ رہ کر ان کے حقوق زوجیت کو نہیں ادا کر سکتی ) ۔ اس پر نبی کریم صلی اللہ علیہ وسلم نے ان سے فرمایا کہ کیا تم ان کا باغ ( جو انہوں نے مہر میں دیا تھا ) واپس کر سکتی ہو؟ انہوں نے کہا کہ جی ہاں۔ نبی کریم صلی اللہ علیہ وسلم نے ( ثابت رضی اللہ عنہ سے ) فرمایا کہ باغ قبول کر لو اور انہیں طلاق دے دو۔

English Translation

Narrated Ibn `Abbas: The wife of Thabit bin Qais came to the Prophet and said, O Allah's Apostle! I do not blame Thabit for defects in his character or his religion, but I, being a Muslim, dislike to behave in un-Islamic manner (if I remain with him). On that Allah's Apostle said (to her), Will you give back the garden which your husband has given you (as Mahr)? She said, Yes. Then the Prophet said to Thabit, O Thabit! Accept your garden, and divorce her once.
