Amr bin Shuaib on his father's authority said that his grandfather (Abdullah ibn Amr ibn al-As): The Prophet صلی ‌اللہ ‌علیہ ‌وسلم said: There is no divorce except in what you possess; there is no possession, there is no sale transaction till you possess. The narrator Ibn as-Sabbah added: There is no fulfilling a vow till you possess.

حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، ‏‏‏‏‏‏حَدَّثَنَا هِشَامٌ. ح وحَدَّثَنَا ابْنُ الصَّبَّاحِ، ‏‏‏‏‏‏حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الصَّمَدِ، ‏‏‏‏‏‏قَالَا:‏‏‏‏ حَدَّثَنَامَطَرٌ الْوَرَّاقُ، ‏‏‏‏‏‏عَنْ عَمْرِو بْنِ شُعَيْبٍ، ‏‏‏‏‏‏عَنْ أَبِيهِ، ‏‏‏‏‏‏عَنْ جَدِّهِ، ‏‏‏‏‏‏أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ لَا طَلَاقَ إِلَّا فِيمَا تَمْلِكُ، ‏‏‏‏‏‏وَلَا عِتْقَ إِلَّا فِيمَا تَمْلِكُ، ‏‏‏‏‏‏وَلَا بَيْعَ إِلَّا فِيمَا تَمْلِكُ، ‏‏‏‏‏‏زَادَ ابْنُ الصَّبَّاحِ:‏‏‏‏ وَلَا وَفَاءَ نَذْرٍ إِلَّا فِيمَا تَمْلِكُ .

عبداللہ بن عمرو بن العاص رضی اللہ عنہما کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: طلاق صرف انہیں میں ہے جو تمہارے نکاح میں ہوں، اور آزادی صرف انہیں میں ہے جو تمہاری ملکیت میں ہوں، اور بیع بھی صرف انہیں چیزوں میں ہے جو تمہاری ملکیت میں ہوں ۔ ابن صباح کی روایت میں اتنا زیادہ ہے کہ ( تمہارے ذمہ ) صرف اسی نذر کا پورا کرنا ہے جس کے تم مالک ہو۔
