Sunan Abu Dawood 2233 - Divorce (Kitab Al-Talaq)

Baab Qasam Aur Kaffaron Ke Ehkaam O Masail

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، ‏‏‏‏‏‏حَدَّثَنَا جَرِيرٌ، ‏‏‏‏‏‏عَنْ هِشَامِ بْنِ عُرْوَةَ، ‏‏‏‏‏‏عَنْ أَبِيهِ، ‏‏‏‏‏‏عَنْ عَائِشَةَ فِي قِصَّةِ بَرِيرَةَ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ كَانَ زَوْجُهَا عَبْدًا فَخَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَاخْتَارَتْ نَفْسَهَا، ‏‏‏‏‏‏وَلَوْ كَانَ حُرًّا لَمْ يُخَيِّرْهَا .

Urdu Translation

ام المؤمنین عائشہ رضی اللہ عنہا سے بریرہ کے قصہ میں روایت ہے کہ   اس کا شوہر غلام تھا، رسول اللہ صلی اللہ علیہ وسلم نے بریرہ کو ( آزاد ہونے کے بعد ) اختیار دے دیا تو انہوں نے اپنے آپ کو اختیار کیا، اگر وہ آزاد ہوتا تو آپ اسے ( بریرہ کو ) اختیار نہ دیتے۔

English Translation

While relating the tradition about Barirah Aishah said “her husband was a slave, so the Prophet صلی ‌اللہ ‌علیہ ‌وسلم gave her choice. She chose herself. Had he been a free man, he would not given her choice. ”
