حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، حَدَّثَنَا هِشَامُ بْنُ حَسَّانَ، حَدَّثَنِي عِكْرِمَةُ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ هِلَالَ بْنَ أُمَيَّةَ قَذَفَ امْرَأَتَهُ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَرِيكِ بْنِ السَّحْمَاءِ، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْبَيِّنَةَ وَإِلَّا حَدٌّ فِي ظَهْرِكَ ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَقَالَ هِلَالٌ:‏‏‏‏ يَا رَسُولَ اللَّهِ، ‏‏‏‏‏‏إِذَا رَأَى أَحَدُنَا رَجُلًا عَلَى امْرَأَتِهِ أَيَلْتَمِسُ الْبَيِّنَةَ ؟ فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ الْبَيِّنَةَ وَإِلَّا فَحَدٌّ فِي ظَهْرِكَ ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَقَالَ هِلَالٌ:‏‏‏‏ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنِّي لَصَادِقٌ وَلَيَنْزِلَنَّ فِي أَمْرِي مَا يُبَرِّئُ ظَهْرِي مِنَ الْحَدِّ، ‏‏‏‏‏‏فَنَزَلَ:‏‏‏‏ وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلا أَنْفُسُهُمْ فَقَرَأَ حَتَّى بَلَغَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ سورة النور آية 6 ـ 9، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَانْصَرَفَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَأَرْسَلَ إِلَيْهِمَا، ‏‏‏‏‏‏فَجَاءَا، ‏‏‏‏‏‏فَقَامَ هِلَالُ بْنُ أُمَيَّةَ:‏‏‏‏ فَشَهِدَ وَالنَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ إِنَّ اللَّهَ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ، ‏‏‏‏‏‏فَهَلْ مِنْكُمَا تَائِبٌ ؟ ثُمَّ قَامَتْ فَشَهِدَتْ، ‏‏‏‏‏‏فَلَمَّا كَانَتْ عِنْدَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ سورة النور آية 9 قَالُوا لَهَا:‏‏‏‏ إِنَّهَا مُوجِبَةٌ، ‏‏‏‏‏‏فَقَالَ ابْنُ عَبَّاسٍ:‏‏‏‏ فَتَلَكَّأَتْ وَنَكَسَتْ حَتَّى ظَنَّنَا أَنْ سَتَرْجِعُ، ‏‏‏‏‏‏فَقَالَتْ:‏‏‏‏ لَا أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ، ‏‏‏‏‏‏فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ أَبْصِرُوهَا فَإِنْ جَاءَتْ بِهِ أَكْحَلَ الْعَيْنَيْنِ سَابِغَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ السَّحْمَاءِ، ‏‏‏‏‏‏فَجَاءَتْ بِهِ كَذَلِكَ، ‏‏‏‏‏‏فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ لَوْلَا مَا مَضَى مِنْ كِتَابِ اللَّهِ عَزَّ وَجَلَّ لَكَانَ لَنَا وَلَهَا شَأْنٌ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ مِنْ حَدِيثِ هِشَامِ بْنِ حَسَّانَ، ‏‏‏‏‏‏وَهَكَذَا رَوَى عَبَّادُ بْنُ مَنْصُورٍ هَذَا الْحَدِيثَ عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَرَوَاهُ أَيُّوبُ، عَنْ عِكْرِمَةَ مُرْسَلًا وَلَمْ يَذْكُرْ فِيهِ عَنِ ابْنِ عَبَّاسٍ.

Urdu Translation

عبداللہ بن عباس رضی الله عنہما کہتے ہیں کہ   ہلال بن امیہ رضی الله عنہ نے نبی اکرم صلی اللہ علیہ وسلم کے سامنے اپنی بیوی پر شریک بن سحماء کے ساتھ زنا کی تہمت لگائی تو آپ صلی اللہ علیہ وسلم نے فرمایا: ”گواہ لاؤ ورنہ تمہاری پیٹھ پر حد جاری ہو گی، ہلال نے کہا: جب ہم میں سے کوئی کسی شخص کو اپنی بیوی سے ہمبستری کرتا ہوا دیکھے گا تو کیا وہ گواہ ڈھونڈتا پھرے گا؟ رسول اللہ صلی اللہ علیہ وسلم کہتے رہے کہ تم گواہ پیش کرو ورنہ تمہاری پیٹھ پر حد جاری ہو گی۔ ہلال نے کہا: قسم اس ذات کی جس نے آپ کو حق کے ساتھ بھیجا ہے میں سچا ہوں اور مجھے یقین ہے کہ اللہ تعالیٰ میرے اس معاملے میں کوئی ایسی چیز ضرور نازل فرمائے گا جو میری پیٹھ کو حد سے بچا دے گی، پھر ( اسی موقع پر ) آیت «والذين يرمون أزواجهم ولم يكن لهم شهداء إلا أنفسهم» سے «والخامسة أن غضب الله عليها إن كان من الصادقين» تک نازل ہوئی آپ نے اس کی تلاوت فرمائی، جب آپ پڑھ کر فارغ ہوئے تو ان دونوں کو بلا بھیجا، وہ دونوں آئے، پھر ہلال بن امیہ کھڑے ہوئے اور گواہیاں دیں، نبی اکرم صلی اللہ علیہ وسلم انہیں سمجھانے لگے: اللہ کو معلوم ہے کہ تم دونوں میں سے کوئی ایک جھوٹا ہے تو کیا تم میں سے کوئی ہے جو توبہ کر لے؟ پھر عورت کھڑی ہوئی، اور اس نے بھی گواہی دی، پھر جب پانچویں گواہی ”اللہ کی اس پر لعنت ہو اگر وہ سچا ہو“ دینے کی باری آئی، تو لوگوں نے اس سے کہا: یہ گواہی اللہ کے غضب کو واجب کر دے گی ابن عباس رضی الله عنہما کہتے ہیں: ( لوگوں کی بات سن کر ) وہ ٹھٹکی اور ذلت و شرمندگی سے سر جھکا لیا، ہم سب نے گمان کیا کہ شاید وہ ( اپنی پانچویں گواہی ) سے پھر جائے گی، مگر اس نے کہا: میں اپنی قوم کو ہمیشہ کے لیے ذلیل و رسوا نہ کروں گی، نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”اس عورت کو دیکھتے رہو اگر وہ کالی آنکھوں والا موٹے چوتڑ والا اور بھری رانوں والا بچہ جنے تو سمجھ لو کہ دہ شریک بن سحماء کا ہے، تو اس نے ایسا ہی بچہ جنا، نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”اگر کتاب اللہ ( قرآن ) سے اس کا فیصلہ ( لعان کا ) نہ آ چکا ہوتا تو ہماری اور اس کی ایک عجیب ہی شان ہوتی“ ۱؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث اس سند سے ہشام بن حسان کی روایت سے حسن غریب ہے، ۲- اس حدیث کو عباد بن منصور نے عکرمہ سے اور عکرمہ نے ابن عباس رضی الله عنہما کے واسطہ سے نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے، ۳- ایوب نے عکرمہ سے مرسلاً روایت کی ہے اور اس روایت میں ابن عباس کا ذکر نہیں کیا ہے۔

English Translation

Narrated Ibn 'Abbas: Hilal bin Umayyah went to the Prophet (ﷺ) and accused his wife of committing illegal sexual intercourse with Sharik bin Sahma. The Messenger of Allah (ﷺ) said: 'Either you produce proof, or you will receive the legal punishment on your back.' He said: Hilal said: 'O Messenger of Allah (ﷺ)! If one of us saw a man over his wife, should he go and search for witnesses?' The Prophet (ﷺ) kept on saying: 'Either you produce proof, or you will receive the legal punishment on your back.' He said: Hilal then said, 'By Him Who sent you with the Truth and Allah will reveal to you what will save my back from the legal punishment.' Then (the following) was revealed: And for those who accuse their wives, but have not witnesses except themselves, let the testimony of one of them be four testimonies by Allah that he is one of those who speak the truth (24:6-9). He recited it until he reached: 'And the fifth; should be that the wrath of Allah be upon her if he speaks the truth.' Then the Prophet (ﷺ) was saying: 'Allah knows that one of you is a liar, so, will either of you repent?' Then the woman got up and took the oaths, and when she was about to take the fifth one; That the wrath of Allah be upon her if he speaks the truth', the people stopped her and said to her: 'It will definitely bring about Allah's curse upon you (if you are guilty).' Ibn 'Abbas said 'So she hesitated, and recoiled so much so, that we thought that she would withdraw her denial. But she said: 'I will not dishonor my family for the rest of their days.' The Prophet (ﷺ) then said: 'Watch her, if she delivers a child with eyes that appear to have Kuhl on them, big hips, and fat shins then it is Sharik bin Sahma's child.' (Later) she gave birth to a child fitting that description. So the Prophet (ﷺ) said: 'If it had not been settled in the Book of Allah [the Mighty and Sublime], I would punish her severely.'
