Narrated Jabir: Some men had superfluous land and they said that they would give it to others to cultivate on the condition that they would get one-third or one-fourth or one half of its yield. The Prophet said, Whoever has land should cultivate it himself or give it to his brother or keep it uncultivated.

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا الْأَوْزَاعِيُّ ، قَالَ : حَدَّثَنِي عَطَاءٌ ، عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : كَانَتْ لِرِجَالٍ مِنَّا فُضُولُ أَرَضِينَ ، فَقَالُوا : نُؤَاجِرُهَا بِالثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ ، فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ .

ہم سے محمد بن یوسف نے بیان کیا، کہا ہم سے اوزاعی نے بیان کیا، کہا کہ مجھ سے عطاء نے بیان کیا، ان سے جابر رضی اللہ عنہ نے بیان کیا کہ   ہم میں سے بہت سے اصحاب کے پاس فالتو زمین بھی تھی، انہوں نے کہا تھا کہ تہائی یا چوتھائی یا نصف کی بٹائی پر ہم کیوں نہ اسے دے دیا کریں۔ اس پر نبی کریم صلی اللہ علیہ وسلم نے فرمایا ”جس کے پاس زمین ہو تو اسے خود بونی چاہئے یا پھر کسی اپنے بھائی کو ہدیہ کر دینی چاہئے اور اگر ایسا نہیں کرتا تو پھر زمین اپنے پاس رکھے رہے۔“
