حَدَّثَنَا عَبْدُ اللهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ، حَدَّثَنَا مَالِكٌ، ح وحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، وَاللَّفْظُ لَهُ، قَالَ: قَرَأْتُ عَلَى مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ، وَلَمْ تُحْصِنْ، قَالَ: «إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ»، قَالَ ابْنُ شِهَابٍ: «لَا أَدْرِي أَبَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ»، وَقَالَ الْقَعْنَبِيُّ فِي رِوَايَتِهِ: قَالَ ابْنُ شِهَابٍ: وَالضَّفِيرُ: الْحَبْلُ

Urdu Translation

  عبداللہ بن مسلمہ قعنبی نے کہا : ہمیں مالک نے حدیث سنائی ، اور یحییٰ بن یحییٰ نے ۔ ۔ حدیث کے الفاظ انہی کے ہیں ۔ ۔ کہا : میں نے امام مالک کے سامنے قراءت کی ، انہوں نے ابن شہاب سے ، انہوں نے عبیداللہ بن عبداللہ سے ، انہوں نے حضرت ابوہریرہ رضی اللہ عنہ سے روایت کی کہ رسول اللہ صلی اللہ علیہ وسلم سے لونڈی کے بارے میں پوچھا گیا ، جب وہ زنا کرے اور شادی شدہ نہ ہو ، تو آپ صلی اللہ علیہ وسلم نے فرمایا : "" اگر وہ زنا کرے تو اسے کوڑے لگاؤ ، پھر اگر زنا کرے تو اسے کوڑے لگاؤ ، پھر اسے فروخت کر دو ، چاہے ایک گندھی ہوئی رسی کے عوض کیوں نہ ہو ۔ "" ابن شہاب نے کہا : میں نہیں جانتا یہ ( بیچتے کا حکم ) تیسری بار کے بعد ہے یا چوتھی بار کے بعد ۔ قعنبی نے اپنی روایت میں کہا : ابن شہاب نے کہا : اور ضفیر سے مراد رسی ہے

English Translation

Abu Huraira reported that Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) was asked about the slave-woman who committed adultery and was not protected (married). He said: If she commits adultery, then flog her and if she commits adultery again, then flog her and then sell her even for a rope. Ibn Shihab said: I do not know whether he said this (his statement pertaining to the sale of slave-woman) at the third or the fourth time. Ibn Shihab said that the word dafir (used in the text) means rope.
