أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى، ‏‏‏‏‏‏وَسُلَيْمَانُ بْنُ دَاوُدَ،‏‏‏‏ عَنْ ابْنِ وَهْبٍ، ‏‏‏‏‏‏أَخْبَرَنِي يُونُسُ، ‏‏‏‏‏‏عَنْ ابْنِ شِهَابٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، ‏‏‏‏‏‏أَنَّهُ سَأَلَ عَائِشَةَ عَنْ قَوْلِ اللَّهِ عَزَّ وَجَلَّ:‏‏‏‏ وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ سورة النساء آية 3،‏‏‏‏ قَالَتْ:‏‏‏‏ يَا ابْنَ أُخْتِي هِيَ الْيَتِيمَةُ تَكُونُ فِي حَجْرِ وَلِيِّهَا فَتُشَارِكُهُ فِي مَالِهِ، ‏‏‏‏‏‏فَيُعْجِبُهُ مَالُهَا وَجَمَالُهَا فَيُرِيدُ وَلِيُّهَا أَنْ يَتَزَوَّجَهَا بِغَيْرِ أَنْ يُقْسِطَ فِي صَدَاقِهَا، ‏‏‏‏‏‏فَيُعْطِيَهَا مِثْلَ مَا يُعْطِيهَا غَيْرُهُ، ‏‏‏‏‏‏فَنُهُوا أَنْ يَنْكِحُوهُنَّ إِلَّا أَنْ يُقْسِطُوا لَهُنَّ وَيَبْلُغُوا بِهِنَّ أَعْلَى سُنَّتِهِنَّ مِنَ الصَّدَاقِ، ‏‏‏‏‏‏فَأُمِرُوا أَنْ يَنْكِحُوا مَا طَابَ لَهُمْ مِنَ النِّسَاءِ سِوَاهُنَّ، ‏‏‏‏‏‏قَالَ عُرْوَةُ:‏‏‏‏ قَالَتْ عَائِشَةُ:‏‏‏‏ ثُمَّ إِنَّ النَّاسَ اسْتَفْتَوْا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعْدُ فِيهِنَّ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ:‏‏‏‏ وَيَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللَّهُ يُفْتِيكُمْ فِيهِنَّ سورة النساء آية 127،‏‏‏‏ إِلَى قَوْلِهِ:‏‏‏‏ وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ سورة النساء آية 127،‏‏‏‏ قَالَتْ عَائِشَةُ:‏‏‏‏ وَالَّذِي ذَكَرَ اللَّهُ تَعَالَى أَنَّهُ يُتْلَى فِي الْكِتَابِ الْآيَةُ الْأُولَى الَّتِي فِيهَا:‏‏‏‏ وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ سورة النساء آية 3،‏‏‏‏ قَالَتْ عَائِشَةُ:‏‏‏‏ وَقَوْلُ اللَّهِ فِي الْآيَةِ الْأُخْرَى:‏‏‏‏ وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ سورة النساء آية 127،‏‏‏‏ رَغْبَةَ أَحَدِكُمْ عَنْ يَتِيمَتِهِ الَّتِي تَكُونُ فِي حَجْرِهِ حِينَ تَكُونُ قَلِيلَةَ الْمَالِ وَالْجَمَالِ، ‏‏‏‏‏‏فَنُهُوا أَنْ يَنْكِحُوا مَا رَغِبُوا فِي مَالِهَا مِنْ يَتَامَى النِّسَاءِ إِلَّا بِالْقِسْطِ، ‏‏‏‏‏‏مِنْ أَجْلِ رَغْبَتِهِمْ عَنْهُنَّ .

Urdu Translation

عروہ بن زبیر کہتے ہیں کہ   انہوں نے ( ام المؤمنین ) عائشہ رضی اللہ عنہا سے اللہ تعالیٰ کے فرمان: «وإن خفتم أن لا تقسطوا في اليتامى فانكحواء ما طاب لكم من النساء» ”اگر تمہیں ڈر ہو کہ یتیم لڑکیوں سے نکاح کر کے تم انصاف نہ رکھ سکو گے، تو اور عورتوں میں سے جو بھی تمہیں اچھی لگیں تم ان سے نکاح کر لو ( النساء: ۳ ) کے بارے میں سوال کیا تو عائشہ رضی اللہ عنہا نے کہا: بھانجے! اس سے وہ یتیم لڑکی مراد ہے جو اپنے ایسے ولی کی پرورش میں ہو جس کے مال میں وہ ساجھی ہو اور اس کی خوبصورتی اور اس کا مال اسے بھلا لگتا ہو، اس کی وجہ سے وہ اس سے بغیر مناسب مہر ادا کیے نکاح کرنا چاہتا ہو یعنی جتنا مہر اس کو اور کوئی دیتا اتنا بھی نہ دے رہا ہو، چنانچہ انہیں ان سے نکاح کرنے سے روک دیا گیا۔ اگر وہ انصاف سے کام لیں اور انہیں اونچے سے اونچا مہر ادا کریں تو نکاح کر سکتے ہیں ورنہ فرمان رسول ہے کہ ان کے علاوہ جو عورتیں انہیں پسند ہوں ان سے نکاح کر لیں۔ عروہ کہتے ہیں: عائشہ رضی اللہ عنہا نے کہا: لوگوں نے رسول اللہ صلی اللہ علیہ وسلم سے ان یتیم بچیوں کے متعلق مسئلہ پوچھا تو اللہ نے آیت «ويستفتونك في النساء قل اللہ يفتيكم فيهن» سے لے کر «وترغبون أن تنكحوهن» ”آپ سے عورتوں کے بارے میں حکم پوچھتے ہیں آپ کہہ دیجئیے کہ خود اللہ تعالیٰ ان کے بارے میں حکم دے رہا ہے، اور قرآن کی وہ آیتیں جو تم پر ان یتیم لڑکیوں کے بارے میں پڑھی جاتی ہیں جنہیں ان کا مقرر حق تم نہیں دیتے، اور انہیں اپنے نکاح میں لانے کی رغبت رکھتے ہو ( النساء: ۱۲۷ ) تک نازل فرمائی۔ عائشہ رضی اللہ عنہا فرماتی ہیں: پچھلی آیت میں اللہ تعالیٰ نے «وما يتلى عليك في الكتاب» جو فرمایا ہے اس سے پہلی آیت: «وإن خفتم أن لا تقسطوا في اليتامى فانكحواء ما طاب لكم من النساء» مراد ہے۔ اور دوسری آیت میں فرمایا: «وترغبون أن تنكحوهن» تو اس کا مطلب یہ ہے کہ جو یتیم لڑکی تمہاری نگہداشت و پرورش میں ہوتی ہے اور کم مال والی اور کم خوبصورتی والی ہوتی ہے اسے تو تم نہیں چاہتے تو اس کی بنا پر تمہیں ان یتیم لڑکیوں سے بھی شادی کرنے سے روک دیا گیا ہے جن کا مال پانے کی خاطر تم ان سے شادی کرنے کی خواہش رکھتے ہو۔

English Translation

Urwah bin Az-Zubair narrated that he asked 'Aishah about the saying of Allah, the Mighty and Sublime: And if you fear that you shall not be able to deal justly with the orphan girls then marry (other) women of your choice. She said: O son of my sister, this refers to a female orphan who is in the care of her guardian, and her wealth is joined to his, and he is attracted to her wealth and her beauty. So her guardian wants to marry her without being fair with regard to her dowry, and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given, and they were commanded to marry other women of their choice. 'Urwah said: 'Aishah said: 'Then later on, Allah, the Mighty and Sublime, revealed concerning them: 'They ask your legal instruction concerning women, say: Allah instructs you about them, and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry.' 'Aishah said: 'What Allah, Most High, mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry (other) women of your choice.' 'Aishah said: 'What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. So they were forbidden to marry those orphan women to whose wealth they were attracted unless they were fair, because of their desire not to marry (those who were lacking in wealth and beauty.)'
