Islam is complete code of life, molds every aspect of
individual and collective lives in the framework of discipline and law.Allah
Almighty has made it obligatory on every human being to enforce this law on
himself, his family and his society, and he will be held accountable for this
duty on the Day of Resurrection. Ignorance of this sense of responsibility
isgreatest tragedy of the Muslims today.
The current humiliation of Muslims is due to their aversion to the Islamic way
of life,because they adopted non-shariah system of life. They, ignoring the
command of Holy Prophet (peace be upon him), chose for themselves the same path
of destruction that the Western world has already been following.The Prophet
(peace be upon him) guided mankind not only to the salvation of the Hereafter
but also to the secrets of living a successful and fulfilling life in this
world.Unfortunately, the Muslims of todayforgot the lesson given by him and
turned away from his instructions.The so-called Muslim rulers suspended the
Islamic punishments imposed by Islam on the perpetrators, saying that these
punishments were based on violations of basic human rights.In this way, Islamic
countries, like the West, became hotbeds of social evils.
Pakistan is one of the leading Islamic states in the world, the only state in
the current geographical division of the world that came into being on the basis
of Islamic ideology. Despite being called an Islamic state, only Islam is
oppressed and abandoned in this country. The rising crime rate and especially
the growing graph of sexual brutality is very painful because our un-Islamic
system is not capable of punishing the perpetrators severely.Before the nation
can recover from the agony of an incident of rape, meanwhile, another tragedy
shatters the moral wall of the country.Law enforcement agencies arrest a
criminal at the risk of their lives but he is easily acquitted by taking
advantage of the lack of evidence, non-compliance or suspicion. Even if the
judge wants to set an example of terrible punishment, he cannot do so due to
legal hurdles. Neither he can decide according to his conscience and emotions,
nor can he apply the provisions of the Shari'ah to punish the culprit.The law
within which the court has to sentence is the evil constitution of world
imperialism, being in force in the subcontinent for one and a half hundred
years.
The general opinion in our society is that our law cannot give rights to the
oppressedand that to get your rights from the court you have to be humiliated in
the courts all your life and a lot of money is wasted.Due to this ideology, 60%
of rape cases go unreportedevery year, meaning that only 41% of cases are
reported to the police.In the last six years, 22,000 cases of rape have been
registered out of which 21,923accused have been acquitted due to lack of
evidence or non-compliance while only 77 have been convicted. Isn't the
acquittal of thousands of accused a question mark over the “law and order” of
the state?Is it our police policy to arrest and interrogate such a large number
of innocent people?If the police arrested the real culprits, how could they be
easily acquitted by the court? DIGOmar Sheikh rightly said that the state had
died on the same day when the politician, who merrily crushed a traffic warden
under his car, was honorably acquitted. Although Omar Sheikh spoke bitter
harshly, yet he spoke the truth. The guilty is neither our police nor the court
but the real culprit is the Man-made law which is contrary to Islamic Shariah.In
this flawed system of justice and punishment, the oppressed are punished first
and then the guilty.However, there are many cases that do not reach a logical
conclusion.Plaintiffs and witnesses get tired of fighting the case or die away,
or the defendants put pressure on them to end the case and thus the blood of
justice is shed.If Shariah had been imposed in Pakistan and the perpetrator
would have been flogged and stoned in the city center, there would not have been
only 22 crimeseven, instead of 22,000.
Neither a government nor any politician is sincere for enforcement of Shariah in
Pakistan. As per reports of our law enforcement agencies, 95% politicians are
corrupt, so why would a thief want a system in which theft is sever
punishable?Why would an adulterer introduce the law of stoning and flogging for
himself?Why would a corrupt person want to be held accountable?No political
power in Pakistan will ever bother to enforce the Shariah. No politician is too
true to dig his own grave. The families and the children of the ruling class are
always under protection, so what do they care about the honor and dignity of the
daughters of the nation?As long as the ruler does not live the life of a common
man, he will never be able to do justice.It is an undeniable fact that no matter
how hard you try, there will be no peace and order in Pakistan unless the
Islamic system of Khilafah is established.
