HARASSMENT (II) (Meeshafi, Vs Ali Zafar, Case)

Today, I have discussed about Meeshafi Vs Ali Zafar Case in light on Harassment Act. Those who have read my first episode they will easily understand this case. This case is going into new dimension in the history of Pakistan. I am not fussy at all. However, in my presumption about this case is slightly different. In my interpretation of about this case there is no bar on this suit by law. Even there is no involvement of new fact or point of law which is essential to apex Court of Pakistan to explicit. There is no Suo motto action required. It is an open and shat case. The rules are predefined in Harassment Act. But the Appellant Counsel has been tried to influence on Court proceeding. There are no such laws or provision is available in Harassment Act if employer do wrong with other employer. Both are in power mode. There are no pending liabilities on each part. There is no financial matter involved in this case.

If something happen among each other which are cause for hurt appellant ego. Without the consent no one harm each other nor blame. If I talk about culture of Music Industry or drama industry is open and friendly. I try to more elaborate this tradition, shaking hands; embracing or kiss each other is common thing. Now question is how he or she trying to influence each other or attempt to sexual desire. It is more complicate question which has determined by the Lahore High Court, Lahore. The LHC has dismissed this petition on the ground of “employer” because both are same scale no one bound to adhering special rules. There is no special task or agreement. The rule of master and servant is not applied. If something happen each other solely basis of mutual consent that there was no evidence to prove in a court. In Pakistan the culture of Film, drama and music are prevailing in different mode and charming style. In my sense the mediocre style has been adopted by two music stars.

On the other hand, Meeshafi is famous singer, should maintain her honor why she file suit in the apex court of Pakistan? He (Ali Zafar), Singer as well as an actor, in my presumption they should settle their dispute beyond the court. In my sense (according to law) there is no collusion between them. It is proverb “always third may get favor” when such a situation where two famous personality in front line is burning atmosphere because others are spectators which are taking keen interest. These types of controversial element are common in showbiz industry to pay such attention from audience. In consequence of LHC decision the rules of harassment Act” should observe in the prospect of evidence which is most complicated even difficult to prove this case beyond the shadow of doubt. Both the parties should prove their cases beyond shadow of doubts. Let’s see what happen next.
